These SMS Terms of Use (“SMS Terms”) describe how Modern Scent (“Modern Scent”, “we”, “us”, or “our”) sends text messages and how you agree to receive them. By signing up to receive SMS or MMS messages from Modern Scent, you agree to these SMS Terms, our Terms of Use, and our Privacy Policy.

1. Agreement to Receive SMS Messages

By opting in to any Modern Scent text program, you expressly agree to receive recurring automated text messages (SMS and/or MMS), which may include promotional messages, personalized offers, cart reminders, and other marketing communications, at the mobile number you provided to us or later updated.

These messages may be sent using automated technology (including systems that can automatically select or dial numbers or use prerecorded or artificial voice) on our behalf or on behalf of our service providers. Your consent to receive text messages is not a condition of any purchase.

Message and data rates may apply. If you have questions about your text or data plan, please contact your mobile carrier. You must be a U.S. consumer, at least 18 years of age, and the owner or authorized user of the mobile number you provide.

This is a standard-rate messaging program. Message frequency may vary based on your interactions with us (for example, cart reminders, promotional campaigns, and alerts). We reserve the right to change the number of messages we send (increase or decrease) and to change the short code or phone number from which we send messages. If we change the number or short code, we will update our communications accordingly.

Not all devices or carriers are supported, and our messages may not be available in all areas. Neither Modern Scent, our service providers, nor mobile carriers are responsible for delayed or undelivered messages.

2. Participating Mobile Carriers

Our text messaging services are supported by many major U.S. wireless carriers. Availability, however, depends on your carrier and your mobile plan. Message delivery is not guaranteed by any carrier.

3. How to Opt Out, Unsubscribe, or Cancel

You can stop receiving marketing text messages from Modern Scent at any time. To unsubscribe, reply to any of our text messages with one of the following keywords: STOP, END, CANCEL, UNSUBSCRIBE, or QUIT.

After you send one of these keywords, we may send you a single confirmation message to verify that you have been unsubscribed. After that, you will no longer receive marketing text messages from that specific program. Please note that you may still receive non-marketing messages (such as order-related notifications) if applicable.

Our messaging platform may not recognize or process unsubscribe requests that do not include one of the commands listed above (for example, “Please stop”, “Remove me”). In such cases, we and our service providers are not responsible for failing to honor those requests. Please use one of the exact keywords listed to opt out.

4. How to Get Help

If you need assistance with our text messaging program, you can:

• Reply to any of our messages with the keyword HELP to receive basic help information; and/or
• Contact our customer support team at support@modernscent.shop.

If your messages are powered by a third-party provider (such as an SMS platform), that provider may also offer support via their own help pages or email. Please refer to any support links provided in our messages, if applicable.

5. Eligibility & Phone Number Changes

By enrolling in our text messaging program or otherwise providing your mobile number, you confirm that:

• You are at least 18 years old;
• You are a U.S. resident;
• You are the current owner or authorized user of the mobile number you provided;
• You will not enroll a number that does not belong to you or that you are not authorized to use.

If you change, transfer, or deactivate your mobile number, you agree to promptly complete the opt-out process for that number (as described above) or notify us so that we can remove the number from our SMS list. Failure to do so may result in messages being sent to a new user of that number, and you agree that Modern Scent will not be responsible for any claims arising from your failure to notify us.

You agree to indemnify and hold harmless Modern Scent from any claims, losses, or liabilities (including reasonable attorneys’ fees) arising out of or related to your failure to properly opt out or notify us when your mobile number changes or is reassigned.

6. Dispute Resolution & Arbitration

These SMS Terms are subject to the dispute resolution and arbitration provisions in the Modern Scent Terms of Use. By agreeing to receive text messages from us, you acknowledge and agree that:

• Any dispute or claim arising out of or related to these SMS Terms or your receipt of text messages from us will be resolved through binding individual arbitration, to the fullest extent permitted by law;
• You waive the right to a trial by jury;
• You waive the right to participate in a class action or representative proceeding against us.

If any part of this arbitration section is found to be unenforceable, the remaining provisions will continue in full force and effect, except as otherwise required by law.

7. Changes to These SMS Terms

We may update these SMS Terms from time to time. When we do, we will revise the “Effective Date” at the top of this page. Your continued enrollment in and receipt of SMS messages from us after any changes have been made will constitute your acceptance of the updated SMS Terms.
